A trade mark is any sign that distinguishes the goods and services of one trader from another — words, logos, pictures, or a combination. To be registrable, your trade mark must be distinctive for the goods or services you’re registering it for, and must not be deceptive, contrary to law or morality, or similar or identical to an earlier mark for the same or similar goods or services.
Registering your trade mark gives you the exclusive right to use your mark for the goods and/or services it covers in the United Kingdom. You can then put the ® symbol next to it to warn others against using it — using ® for an unregistered mark is an offence.
Deters others from using your trade mark without permission.
Makes it far easier to take legal action against anyone who uses your mark without permission.
Lets Trading Standards or Police bring criminal charges against counterfeiters using your mark.
Is your property — you can sell it, franchise it, or license others to use it.
The initial fee for trade mark registration in one class is £465 + VAT, including the issue of the Registration Certificate. If the Registry refuses the application outright, £315 + VAT is refunded. If the mark can be amended to meet the Registry’s requirements, it can be resubmitted for an additional £150 + VAT. Each additional class is £50 + VAT. Registration is subject to the availability of the trade mark.
“Working with Des and his team made the process of securing my Steve’s Cakes logo effortless and an extremely valuable exercise. His knowledge of what to and not to do is vast and true — I would highly recommend The Company Shop.”
